C-92-012 <br />Dear Ms. Binns: <br />iii iiiiiiiiiiiiiiii <br />999 <br />JU! 23 ~ <br />M1NE~ALS ~ OLOGV <br />July 17, 1992 <br />Western Fuels-Utah hereby contests the referenced notice of violation which was issued for "failure <br />to install sediment control measures on degas well pads LWS-6 and LWS-66". WFU does not <br />believe that a permit violation has occurred. We present the following facts to support our position. <br />1. Page III-36 of WFU's mine permit document states that two temporary mud pits are <br />constructed at the lowest elevation of a drill site. These pits effectively serve as the <br />sediment control structure for the disturbance. My runoff water orwater/drilling mud mixture <br />is collected in the pits. WFU has followed this measure during the drilling of vent holes. <br />2. The permit also states that a small bens is left along the downhill side to serve as a <br />sediment control structure during revegetation. The notice of violation was issued primarily <br />for the lack of the berms at the drill hole sites LWS-6 and LW5-66. Please note that the <br />berms were constructed as of July 16, 1992. <br />3. The drill sites in question are small.
