Division Director <br />14300 Highway 12 <br />Weston, CO 81091 <br />Re: Notice of Violation C-94-019 <br />New Elk Mine, Permit No. C-81-012, Basin Resources, Inc. <br />Dear Mr. Lopez: <br />The Division has modified NOV C-94-019 for the New Elk Mine. Culvert C-35 has been <br />deleted from the NOV. The inspection of August 12, 1994 found that culvert C-35 was two- <br />thirds full of sediment and, therefore, was considered out of compliance. In Basin Resources' <br />letter of September 7, 1994, it was stated that culvert C-35 was oversized and that it could have <br />passed the design flow. <br />Calculations show that the partially filled culvert could have handled .63 CFS. The design flow <br />for culvert C-35 is .28 CFS. Therefore, Basin Resources' assertion that C-35 could have passed <br />the design flow even though it was two-thirds full of sediment is correct. <br />The modification form for NOV C-94-019 is enclosed.
