<br />,~ - <br />Mr. Glen Golden, Civil Engineer -2- April 4, 1996 <br />Office of Surface Mining <br />- In Section 2.05.4(2) (c), page 14, of the Reclamation Plan, as revised in October 1995, it is <br />stated that reclamation will be conducted in two phases. Is DNR planning a two phase <br />reclamation operation? If so, has a schedule been established for the reclamation phases? <br />At this time, it is our intent to conduct reclamation in two phases. The sediment pond and <br />drainage control ditches would be removed a few years subsequent to initial baclcfilling, topsoil <br />redistribution and seeding. <br />- In item (8), page 13 of the revised Reclamation Plan it is stated that "Non-coal waste from the <br />underground mine may be brought to the surface and placed in the refuse pile as shown in <br />Exhibit 9. This refuse pile is to be a permanent structure and would consist of roof fall <br />material. " However, the postmining topography depiction presented in Exhibit 19 (Post-Mining <br />Topography of O. C. N2 Coal Mine) shows no indication of the refuse disposal structure. Does <br />DNR plan to create the refuse disposal pile that is discussed ors page l3 and shown in <br />Exhibit 9? If so, please explain the reasons for retaining such a structure. <br />There is no significant amount of underground mine waste at the surface, and there will not be <br />any refuse pile following reclamation of the site. <br />- From aerial photographs reviewed in the State f=les and the observations recorded in a DNR <br />inspection report, dated 5/3/95, it will be necessary to remove and bury sediment from the lower <br />diversion as part of the backfilling operation. What are the disposal plans for the diversion <br />material? <br />Any sediment present in the lower ditches will be appropriately managed during reclamation. <br />The sediment will either be disposed during initial backfilling, or during backfilling of the <br />sediment control system. <br />- State Rule 2.05.6(6) requires a subsidence survey, subsidence monitoring, and subsidence <br />control plan. Liu[e information was found in the permit that addressed subsidence. The only <br />place found in the permit that discussed subsidence e„~ects was the paragraph of item S, <br />page 14, which stated simply that "subsidence expressions, "including eroding gullies, will be <br />backf~lled and graded to eliminate depressions. It is not clear whether this reclamation will <br />prevent a lessening of the land use should additional subsidence occur in the future, which is a <br />finding required by State Rule 2.05.6(6) (~ (iii). Has such a determination been made? <br />A special concern was raised by the landowner (John Waish) regarding the ground cracking <br />along the fence line to the west of the mine entrance. (See the 10/16/95 State inspection report <br />C-80-002.) The inspector speculated that to fix the subsidence effects, part of the fence would <br />have to be temporarily removed to permit backf~lling and grading of the area. The mine <br />operator (Mr. Weaver) was to perform this work by November 1, 1995. No information was <br />found in the permit that indicated the work had been completed. If the work has not been <br />completed, will the DNR reclamation plan include the subsidence repairs, including the need to <br />temporarily remove the fence? <br />
