This letter responds to your letter of December 29, 2000,
in which you have requested an additional 60 days beyond January
16, 2001 to obtain a reclamation performance bond to replace the
Frontier bond.l
Colorado Division of Minerals and Geology regulations
require "good cause" before the Division of Minerals and Geology
("CMG") may grant an extension of time to abate a Notice of
Violation. See 2 C.C.R. § 5.03.2(2)(b).
DMG cannot consider your request for additional time until
Powderhorn Coal Co. attempts to show good cause by committing to
obtain a replacement reclamation. performance bond and by setting
forth the specific, concrete steps it intends to take to obtain
such a reclamation performance bond.
Please submit Powderhorn Coal Company's commitment in
writing to replace the Frontier bond, along with a description
of the specific, concrete steps it intends to take to obtain a
replacement reclamation performance bond, to the following
addresses by noon on Friday, January 12, 2001:
