Julian <br />Mitchell and I have reviewed the assessment on the NOV. As Dan Mathews <br />was advised by phone today, we wish to accept your assessment of $600. <br />Although we are accepting the proposed penalty from Mined Land Recla- <br />mation, I feel that a few comments should be made for the record. <br />First, Julian Mitchell feels that there is no indifference in his <br />approach to maintaining the mine bench. He cites numerous occasions <br />in the months preceding the NOV when either contractors' equipment or <br />Blue Ribbon Coal Company equipment has been involved with bench grading, <br />bench stabilization, and installation of drainage devices. <br />Secondly, your inspection occurred on a day when both the Mine <br />Superintendent and the Mine Engineer happened to be unavailable. It is <br />our opinion that the bulk of the slide you referenced had occurred <br />closer to the time of your inspection, as opposed to your observation of <br />more than ten days prior to the inspection. <br />Lastly, a spring appeared on the surface of the mine bench for the <br />first time this morning. Some of the bench slide problem may be caused <br />by subsurface water flow under the mine bench, rather than surface <br />water soaking into the mine bench. <br />In summary, we are not asking for these factors to change the <br />assessment, but only for MLR to recognize that there is no negligence <br />concerning Blue Ribbon Coal Company's efforts to handle properly the <br />mine bench movement. We also ask you to recognized that the outer edge <br />of the mine bench does creep over time. It is reasonable that the mine <br />communicate that status with MLR on an occasional basis, but there is <br />seldom an "event" that requires immediate notification of your office. <br />Sincerely yours, <br />WS`I~ <br />William S.
