Dear Mr. Mount: It has come to the attention of this Department that violations of the above mentioned mining permit are occurring with regard to the type of mining allowed. The operator, Albert Frei, received approval for mining sand and gravel resources in 1986 (County Case Number 59-86-C), and was required to mine the pit wet. Several telephone calls have been received from adjoining property owners claiming that their shallow water wells have recently dried up due to the dry mining being done at the Frei pit. This appears contrary to the approved State mining permit as well as to the Adams County Conditional Use Permit. This letter is a formal. request from the County to the Division of Minerals and Geology for your enforcement action.
