Long <br />Division Dnenor <br />Attached please find the Settlement Agreement for Cessation Order <br />CO-93-031. An assessment conference was held at the Division's <br />office on July 13, 1993. In attendance at the conference, in <br />addition to yourself and me, were Joe Dudash and Wally Erickson <br />representing the Division and Frank Bartlett, Greg Lewicki and <br />Gary Hanish representing Trinidad Basin Mining Company. If you <br />agree with the penalty, please sign the settlement agreement <br />within ten (10) days. If you disagree with the settlement <br />agreement, do not sign it. The Division will fix the penalty <br />pursuant to Rule 5.04.3(5) and you may request a Board Hearing. <br />This settlement agreement is late in coming. I had recommended <br />to the Director that the penalty be reduced to zero, since the <br />permit has been revoked and the bond has been forfieted. <br />However, the Director did not agree. Therefore, the penalty will <br />remain at $112,500.00 as originally proposed. <br />If you have any questions regarding the settlement agreement, <br />please feel free to call me.
