<br />11. Usa: Irrigation, domestic; recreation, fish and wildlife propagation,
<br />replacement and augmentation. The lands proposed to be irrigated are described
<br />as follows:
<br />a. The 5E1/4 of the SE1/4, §Z0, T2N, R68W tying east of the C8&Q Railroad
<br />right-of-way.
<br />b. The S1/2 of the N1/2 {lying west of the Weld County Road) in §21, T2K,
<br />R68W, and the SW1/4, §21, T2N, R881t, and a triangular tract of land in the SW
<br />corner of the 5W1/4 of the SE1/4 of said §21 lying west of the Weld County Road,
<br />one acre (more or less) excepting therefrom 8 acres conveyed to the Great West
<br />Sugar Company, also excepting apart of the SW1i4 of the 5W1/4 lying west of the
<br />railroad consisting of approximately IO acres.
<br />c. A part of the NEl/4 of the NE1/4 of §29, T2N, R68W, lying east of the
<br />railroad right-of-way and west of the Weid County Road, and north of the
<br />centerline of the farm lane.
<br />d. Approximately 7.49 acres in the Ni/2 of the SW1/4 of §21. 72N, R68W
<br />described as follows: beginning at a point south and east of the centerline of
<br />the railroad whence the center of §2I bears N 64.20' E 1326 feet; S 61'20' E 399
<br />Peet; S 32'80' W 678 feet to the south tine of the NI/2 Of SWI/4, then N 88'13'
<br />W to a point SO feat from the centerline of the railroad, than N 34.49' E 908
<br />feet to the point of beginnittg.
<br />e. The 5E1i4 of the NEI/4 and the NE1/4 of the 5E1/4 of §20, T2N, R68W.
<br />12. We11 Permit: Stromquist Ponds 1, 2, 3, and 4, are currently being excavated
<br />as part of a gravel mining operation. At this time, the Ponds may not bo soaled.
<br />Ground water which may enter the Ponds is returned to Boulder Creek. Western
<br />Mobile, Inc. has applied fora Gravel Pit Well Permit for the Ponds 1 through a
<br />respectively, pursuant to the Augmentation Agreement between Stromquist Farms,
<br />the Water Users Association of Water District No. 6, the Rural Ditch Company, the
<br />Godding Ditch Company, the Smith and Emmons Oitch Company, and frontier
<br />Materials, Inc., dated March 29, 1983: ' Stromquist Pond No. 5 shall not be
<br />excavated so as to intercept grounl(; water until and unless a well permit is
<br />issued for the same. This decree does not grant an underground water right. If
<br />this water right is made absolute, all wait permits granted for structures
<br />decreed herein shall be null and void.
<br />I3. Administration: Stromquist Ponds 1, 2, 3, 4, and 5 are planned to be sealed
<br />to prevent the inflow of ground water. Therefore, no augmentation is required
<br />as Only water diverted to priority will be stored in the Ponds. The Applicant
<br />sha11 install the necessary measuring devices, including but not limited to,
<br />staff gauges in each Reservoir, and account on a monthly basis for inflow and
<br />outflow, evaporation, precipitation, change in storage and any seepage. Prior
<br />to making this decree absolute, Applicant shatT develop and submit to the court
<br />and all ob,jectars graphs showing height - storage relationships. Under no
<br />circumstances may the Applicant withdraw more water from the Ponds than was
<br />measured into the Ponds with appropriate evaporative losses being deducted. This
<br />decree dohs not permit the storage and use of ground water. At any time the
<br />Applicant seeks to make this water right absolute, it shall bear the burden of
<br />proving that it can be administered.
