Savage <br />Ooservations/Enforcement - <br />The following includes a discussion of General Comments aoout the project and <br />inspection, information pertaining to Compliance with the Colorado Surface <br />Coal Mining Reclamation Act, and Problems identified that need to be <br />corrected, and any Enforcement actioT ns taken for failure to comply with the <br />Act, Regulations, or approved reclamation plan. <br />The operator had taken steps necessary to abate Violation No. 83-30. The <br />operator had completed the construction of diversion ditch D-1 and the <br />sediment pond spillway structure and dewatering device. The operator had also <br />removed coal waste from the bench outslope and placed it in an area on the <br />bench. <br />It was noted during the course of the inspection that the operator has been <br />selling coal to local purchasers. The operator has stated that the coal is <br />for test burn purposes. This inspector observed one such transaction during <br />the course of this inspection. These activities are not in accordance with <br />the approved Notice of Intent. For this reason, Notice of Violation No. 83-34 <br />was issued to the operator on December 15, 1983. <br />As noted in Notice of Violation 83-34, the operator is not to remove any coal <br />from the exploration site. <br />Doc.
