<br />u <br />AGREEMENT <br />1. PARTIES. The parties to this Agreement are <br />COAL, MINING PARTNERS (hereinafter "Coal Partners"), a general <br />partnership comprised of Charles L. Silengo, Paul J. Silengo, <br />James L. Dunn, J. Murray Rawson, Ted Hanks, C. DeLynn Heaps <br />and Ted Miller, and COAL FUELS-WILDE (hereinafter "CFW"), a <br />r, <br />general partnership comprised of Alfred G. Hoyl and Donald E. <br />Wilde. <br />2. EFFECTIVE DATE. The Effective Date of this <br />Agreement shall be December 31, 1976, regardless of the date <br />upon which it is actually signed by the respective parties <br />~1 <br />hereto. <br />3. PROPERTIES SUBJECT TO THIS AGREEMENT. The <br />properties subject to this Agreement are described as follows: <br />A. Lynch Lease: A Lease Agreement dated <br />tdovember 27, 1974 between Mr. Dale Lynch and Mrs. Lillian <br />Lynch, as Lessor, and Alfred G. Hoyl, as Lessee, covering <br />400.00 acres, more or less, in Mesa County, Colorado. Said <br />Lease Agreement is attached hereto as Exhibit A and shall <br />hereinafter be described as the "Lynch Lease." <br />B. Prospecting Permits: Coal Prospecting <br />Permits Nos. C-0127832, C-0127833 and C-0127834, covering <br />.`/ <br /> <br />
