BOX I30 <br />ROLLINSVILLE, COLORADO BOa7a <br />PHONE: 307-629-0431 <br />October 30, 1991 <br />Steve Renner <br />Coal Program Supervisor <br />Mined Land Reclamation Division <br />Department of Natural Resources <br />1313 Sherman St., Room 2] 5 <br />Denver, CO 80203 <br />Re: Anchor Tresner Coal Unit, File No. X-91-209-00 <br />Dear Steve: <br />Following our meeting of yesterday, I have checked out the dates pertinent to the <br />road and bench construction at the Anchor Tresner Coal Unit north of Fruita, Colorado. <br />On December 31, 1976, we concluded an agreement with Coal Partners. The <br />agreement called for "within six months after the effective date of this agreement Coal <br />Partners shall have and be continuing multiple entry systems into the Anchor Tresner Unit <br />for the purpose of obtaining production of coal from the Anchor Tresner Unit". The six <br />month period would end June 30, 1977. <br />On February 24, 1977, we submitted a mine plan to the Area Supervisor, U. S. <br />Department of the Interior Geological Survey. <br />On June 17, 1977, in a further letter to the Area Supervisor we stated, "We have <br />commenced roads and preparation of outcrop entry sites on the Anchor and Cameo seams <br />on the fee land we control as per our mine plan submitted February 24, 1977:' <br />The roads and benches were prepared and entries commenced during the six month <br />period ending June 30, 1977; therefore the benches and so-called highwalls were in existence <br />prior to August 3, 1977. <br />We should also like to emphasize that to destroy the remaining Cameo bench and <br />access road would severely handicap, if not completely destroy, our ability to proceed with <br />the Anchor Tresner Coal Unit. It would also be against the wishes of the owners of the fee <br />land containing the Cameo bench. <br />
