C-91-024
Dear Steve:
1645 Court Place
Suite 309
Dem•er, Colorado 60202
(303629-9335
After investigating the circumstances of the initial construction
of the Fruita #1 Mine bench area, it has become apparent that the
entire bench area was constructed prior to August 3, 1977. I have
contacted a number of people who were involved with the operation
at that time and I have received letters describing their
recollection of the construction. Although these letters do not
scientifically prove that the bench area was built prior to the
8/3/77 date, the cumulative effect of the letters is strong. Actual
dated pictures or written evidence is simply not available.
The following information was obtained and is enclosed:
1) Letter from Al Hoyle to Steve Renner on October 30, 1991 which
discusses a number of facts and dates that indicate the bench area
was constructed prior to 8/3/77. The most significant piece of
evidence is the letter from Coal Partners to the USGS on June 17,
1977 which stated" we commenced roads and preparation of outcrop
entry sites on the Anchor and Cameo seams on the fee land we
control as per our mine plan submitted February 24, 1977."
2) Second letter from Al Hoyl to Steve Renner on December 4, 1977
with additional information on the actual mine startup.
3) Letter from Randy Denison, the earthwork contractor who was
involved with the actual bench construction at the time. He states
" a substantial amount of work was done on the Fruita Coal Mine
prior to August 3, 1977."
4) Letter from Charles Silengo (General Manager of Operation) to
the Mine Safety and Health Administration dated June 23, 1978,
which states We are driving rock tunnels now and hope to be in
