At your request, this letter eL•lriiie;s our incencions in correspondence previously submitted at the Pre-
HearingConference on 30 January 2004, and erroncrously dated 29 September 2004. It is our
understanding that the Divisiem was confused by ot~r correspondence and requests cluification, as
follows:
As originally requested on 30 J•enuery 2004, and in order to allow adequate tune to respond to the
DivL~ion's correspondence of 6 Janu•,uy 2004, including appropriate engiluering evaluation of
Rtoundwarer and EEMA related concerns, please extend the decision date a minimum of 90 days !torn
11 Fcbn~. This is in patt due to the concern of Anderson Cnn;;ulting that its initial analysis of the
FEMA related concerns may take through April 2004 rn complete.
Linlcss unforeseen cizcumseances present themselves, we believe this will provide sufficuut rune w
gather, analyze and present the engineer's finduigs in reply co the Division's concerns. It is rnu
understanding that t11e request for a minimum of 90 days will provide opporruniry to requesc another
extension and correspondingly additional tune may he allowed by the Division for gorxl cause shown.
