Bliss; Patrick Groom; kogle@co.weld.co.us; Brad Anderson
Subject: RE: Bliss Varra Agreement
Forrest:
My discussions with Chris Varra late yesterday indicated that he is not willing to sign this agreement. However, we will continue to
work with the Bliss's to satisfy the requirement for an Interim Flood Control Measure. To that end we are pursuing approval of our
latest plan for a temporary spillway with the appropriate regulatory agencies.
I might add, the following observations to provide some light on Varra Companies decision to not continue with the berm approach.
It appears to me that the Objector is still having difficulty understanding the intent and the process by which DMG has presented to
resolve the requirements associated with Varra Companies, Inc.'s amended permit application. Technical and legal issues in the
agreement aside, I counted at least three references to the Final Flood Control Mitigation Plan. It is my understanding that we are
working on the Interim Measure and that the Final Measure is a separate plan. This is just one example of numerous issues which
would need resolution prior to commencing with the berm approach.
Chris Pauley, P.E.
Project Manager
Anderson Consulting Engineers, Inc.
772 Whalers Way, Suite 200
Fort Collins, CO. 80525
Tel. Advise if you are willing to consider this agreement or if you no
longer desire to work with my clients. The Bliss's are willing to continue to work with
Varra to reach a reasonable agreement and construct the berm.
Forrest Leaf, P.E.
Leaf Engineering, Inc.
820 13th Street
Greeley, CO 80631
(970) 351-0210 telephone
(970) 392-0300 fax
Forrest leaf .gwest.net
3/9/2005
