The Board <br />hereby reai'ftrms the comments set fot171.ia its prior letter. It remains the Board's <br />position that the Mined Land Reokmation Board should issue a cease anti desist order <br />until the Pathfinder pie operator submits a permit revision that conraias as adequate <br />eneiaeerlny detnoturratioa of atxitility fo'r the recoeatructod fill for the pit acceu road. <br />It is the Board's tmderatandiug that the pCrmittee has recently submitted a terhaieal <br />reViaiOn that ptop0lea certain meaeure8 to be Wldeita$ea to ensure end maintain the <br />stability of rile fill iasderlying the pit access road and Public Service Caaspa~'s Ames <br />penstock. The Board i~aa been foLormed that this techrdcel revisiop does not include an <br />evaluation prepared by a qualit' tad Colorado protesaional engineer of tits stability of the <br />existing fill.
