PHONE: 970-351.7007 <br />They continue to raise the elevation ofthe berm knowing they are in violation of the law end having no <br />consideration for their neighbars by possibly pushing flood waters onto their land. The berm on Verra's <br />side of the river is a lar higher than on our side, and if a flood does occur, the flood will push the water <br />oato the north side of the river due to the building up of the berm ost the south side. In a Fleeaway ,there <br />is supposed to be no buildup of matcriels or structtues to disturb the nature) flow of water in a event of <br />floods or high water. We have an Industrial Park already existing north of the river in the flaodplain with <br />numerous carnmereial buildings and plan to continue to build. We are very concerned about flooding on <br />our side due to the floodway violations that Varna Co. Inc. has inwned. <br />We are asking you to reconsider this permit and take necessary action against Varna Co Inc. to rattan the <br />berm to it's original height of S Poet high from the bottom of the river bed. <br />Enclosed are pichuea of Varna Co Inc. dumping dirt onto the term and raising the elevation of the berm <br />or dike. Please note, writing on front or back of pictures explaining different heights of original berm and <br />elevated Uerm done by Varna Co. inc. <br />Also enclosed is inforrnation from the City Of Greeley on the new studies of the Floodway and Floodplain <br />and their fcelings ~ Varna ever being out of the Floodway. <br />In addition, the new gravel pit well permit that they are requesting concerns ua in depleting the existing <br />wells an our property. The production use of O.T2 MGD, 15 aae,feet will lower the water table for our <br />wells and will cause a hardship due to the fact that we won't be able to water our landscape trees and <br />bushes.
