Re: Notice of Violation, Sierra Grande Site, File No. M-94-103
Dear Mr. Gallegos:
Action by the Colorado Mined Land Reclamation Board at their October 20, 1994
meeting resulted in their issuing the enclosed Cease and Desist Order applying
to the operation described above.
The Cease and Desist Order requires an immediate cessation of mining at the
above described site. This matter may also be placed on the Board Agenda for
the possible imposition of civil penalties, if the corrective action dates, as
set forth on the attached Notice of Violation No. M-94-050, are not met on
time. Attention is called to the following provision from C.R.S. 34-32-123(2):
"Any operator who operates without a permit or a prospector who
prospects without filing a notice of intent shall be subject to a civil
penalty of not less than one hundred dollars per day nor more than one
thousand dollars per day during which such violation occurs; except
that any operator eligible fora permit under Section 34-32-110 shall
be subject to a civil penalty of not less than fifty dollars nor more
than two hundred dollars per day during which such violation occurs."
