WI'MAN'S REQUEST FOR PERMIT <br />REINSTATEMENT, FILE NUMBER M-1983-037/ <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br />January 11, 2006, in Denver, Colorado for a hearing to consider a request by Louis W. <br />Wyman ("Operator") for reinstatement of a forfeited permit. The file number in this matter <br />is M-1983-037. Louis W. Wyman ("Operator") appeared on his own behalf. James Duplex <br />appeared on behalf of the Division of Minerals and Geology ("Division"). <br />The Board, having considered the parties' presentations and having been otherwise fully <br />informed of the facts in this matter, hereby enters the following findings of fact, conclusions of <br />law and order: <br />The Operator received a Section 110c reclamation permit for a sand and gravel operation <br />in 1983. The Operator's excavation activities are located on 9.50 permitted acres in <br />Section 17, Township 4 North, Range 89 West, 6`h Prime Meridian, Routt County, <br />Colorado. The site is known as the Wyman Pit. The Operator submitted a bond of <br />$5,000.00 to the Division to secure reclamation of the site. <br />2. The Operator failed to file an annual report and failed to submit an annual fee of $281.00 <br />to the Division on or before the anniversary date of the permit (May 31, 2005), as required <br />by Section 34-32.5-116(3)(a) of the Colorado Land Reclamation Act for the Extraction of <br />Construction Materials, Section 34-32.5-101 et seq., C.R.S.
