The activity proposed by this application to amend M-2001-085 does not include
significant ground disturbing activities. Footers will be placed adjacent to the Fulton
Ditch to place a bridge across the Ditch; and attached to this Exhibit S is an agreement
executed between the Applicant and the Fulton Irrigating Ditch Company, which states
that the Applicant will compensate the Ditch Company for any damage that occurs to the
Ditch as a result of the activities proposed by the Application to Amend. The agreement
in Exhibit N, in which the Henderson Water Ski Club, LLC grants aright-to-enter to the
Applicant, also includes agreement by the Applicant to compensate the water ski club
and/or its members for any damage that occurs to structures during activities proposed by
this Application to Amend M-2001-085. No other proposed activity has the potential to
adversely affect permanent man-made structures within 200 feet.
