Schleich and Irene Schleioh, 61253 LaSalle Road, <br />Monttos ,Colorado 81401 ("Grantors', and SBcR Delta Partners, LLLP,1363 F Road, Delta, <br />Colorado 81416 ("Grantee'. <br />1. Grantors are the owners of the property described asthe El/2 , SW 1/4,.Section <br />13, T.49N, R.IOW, N.M.P.M., which property shall be burdened by the easement <br />herein and is referred to as "Parcel A." <br />2. Grantee is the owner of the property more particularly described in the attached <br />. Exhibit 1, which property shall be benefitted by the easement herein and is <br />referred to as "Parcel B:' <br />Grantors hereby grant and convey an easement over and across Parcel A, <br />approximately 30 feet in width, along the full length of the extreme eastern <br />property boundary of Parcel A, adjacent to the west side of the existing irrigation . <br />ditch owned by Uncompahgre Valley Water Users Association. The purpose of <br />the easement is to provide vehicular ingress/egress from Parcel B, which is also <br />known as Spring Creek Gravel Pit. The easement may be used by Grantee, its <br />successors, employees, invitees, and authorized contractors for the duration of this <br />easement. <br />a. The easement may be used for the transportation of rock, sand, gravel, <br />asphalt, and all associated processed materials, and any and all incidental <br />uses, including transport of materials and equipment and ingress/egress by <br />delivery vehicles and employees. <br />4. Grantee, or its authorized contractor, shall provide for the construction and <br />maintenance of the easement road consistent with all permit terms contained in <br />Montrose County Special Use Permit, Number SU-99-1154. Grantee shall obtain <br />all required permits and shall bear all costs of construction and maintenance of the <br />easement. <br />Grantee will relocate the existing irrigation ditch that conducts water to the <br />Grantor's fields in Parcel A. The ditch will be replaced by an underground <br />pipeline of PVC or other suitable material of a sufficient grade and size to conduct <br />the quantity of water currently transported by the ditch as of the date of this <br />agreement. The ditch shall be constructed along the length of the easement from <br />the intake structure at LaSalle Road to the outfall point of the northern most field <br />in Parcel A. <br />Page 1 of 4 <br />
