Actually, most of <br />the response has been completed for some time. The last item that was holding up the entire response was the <br />agreement between the company and Detta Helmsing regarding her objection to the well permit application. That is <br />noun completed and the responses can be provided for your review. <br />Please note that this letter and its contents are being sent from Transit Mix rather than from myself. I will be gone <br />for the first tvo weeks in October and the full signed agreement with Ms. Helmsing was not ready by the time I was <br />leaving. The date of this letter is being entered manually once the agreement is completed and signed. If you need to <br />discuss these responses you may call my office phone. Your call will automatically be forwarded to my cell phone. I <br />may not always be available but messages will follow me so I can respond as soon as I am back in a digital phone <br />area and I receive the message. Don't hesitate to call if you need to. <br />The responses to follow are consistent wide your format and numbering. The entire question is only summarized <br />rather than repealed. <br />Item 1 - Exhibit C - (summary) Include power and commun[cation lines on maps. <br />Response: After reviewing your question and the permit maps, there did not seem to be much point in <br />replacing all the maps. Therefore, only two were modified to include this information. Those are Exhibit C-2 Surface <br />Owners and Exhibit C-4 Phase 1 Detail Map. It appeared the inforration was most relevant to these two maps. The <br />Aquila power line along US 50 and into the site are shown on both maps. Only part of the line into the site is owned <br />by Aquila, the rest of the lines throughout the site are owned by the operator. The revisions are noted in a small <br />squaze near the title block. These maps should replace the original application maps. <br />In addition to the inclusion of the power lines on the map, there is a notarized letter of agreement <br />between Transit Mix of Pueblo and Aquila regarding any damages to the line. That letter is included in the additional <br />information. For your information, Aquila is what was' formerly known as West Plains Energy. <br />Item 2 -Rule 3.1.5 - Backfilling - (summary) Question regarding compaction of backfilled slopes. <br />Response: The customary approach to constmcting these slopes and the method that has been used in <br />creating similar slopes at the Pueblo West Pit, is' to use scrapers to lay in the material in lifts. These lifts are only a <br />few inches thick. Although a separate compaction step is nor used, this method of creating the slopes has been <br />shown to be acceptable and stable. Furthermore, after the slope is created with scrapers, a dozer is used to grade the <br />outer slope of the fill. This- provides additionail compaction. Because the slopes will be no steeper than 3:1, and <br />
