boundaries for Division inspectors and the area of liability. <br />Fault <br />Contrary to what is written in the proposed penalty, the operator <br />was not aware of the damage 6 weeks prior to the issuance of the <br />NOV. The inspection report that identified the problem was sent <br />to a Colorado address rather than the California address where <br />the representatives are now located. As soon as they became <br />aware of the problem in June, the signs were ordered. <br />If it were only the knocked down identification sign being <br />considered I might recommend the penalty be reduced, but several <br />of the perimeter markers were missing and the standing markers <br />were difficult to identify. I agree with the proposed penalty. <br />Good Faith <br />Based on the information presented in the conference, I believe a <br />reduction for good faith is warranted. The signs were installed <br />two days after the NOV was served to the operator by mail, on <br />July 7, 1993. A contractor was hired to do the work. I <br />recommend a $100.00 reduction. <br />Settlement Agreement Penalty Proposed $400.00 <br />
