• <br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF THE RECLAMATION RESOURCES SITE, PERMIT N . M-85-029, <br />REQUEST FOR DECLARATORY ORDER, NO. 0-99-022, EXEMPTING CE TAIN <br />ACTNITIES FROM RECLAMATION PERMIT AMENDMENT REQUIREM NTS <br />THIS MATTER having come before the Mined Land Reclamation Board ("the oazd") on April <br />28, 1999, for a hearing pursuant to Rule 2.5 of the Hard RocklMetal Mining Rul s and <br />Regulations, the Board makes the following Findings of Fact and Conclusions of Law, and enters <br />the following Declazatory Order: <br />FINDINGS OF FACT AND CONCLUSIONS OF LAW <br />1. Reclamation Resources, Inc. ("RRI"), operates the Alma Placer site in Park <br />County Colorado, Sec. 12, T9S, R78W, 6th P.M., under Permit No. M-85-024. ', <br />2. RRI desires to move excess overburden from its permiaed area on o adjacent land <br />which is not permitted but is subject to disturbance from pre-law activities. RRI mends to fill <br />holes on the adjacent land, and to regrade the land so as to reclaim it and alleviat safety <br />concerns. The desired activities will also benefit RRI's permitted mining operati n by allowing <br />it to remove excess overburden from its mineral deposit. <br />3. Dennis Ducommun, representing RRI, petitioned the Board for a tileclaratory order <br />stating whether the activities described above would require an amendment to I's existing <br />permit. The Division received the petition on April 15, 1999. <br />4. The excavation and hauling activities being carried out by RRI wil~not be <br />considered mining activities as described in Construction Material Rule 1.2, so to gas: <br />• RRI posts an additional reclamation bond, as set by the Division of Minerals ~nd Geology, to <br />cover the cost of reclamation on the un-permitted affected areas ' <br />• RRI's activities described above are concluded within five (5) years of the sig~tature date of <br />this Order <br />• By the Division's determination, the un-permitted affected area is sufficiently (graded and <br />backfilled, and left in an erosionally stable condition. <br />DECLARATORY ORDER <br />
