Funk as Grantors and Routt County, Colorado as Grantee. <br />LEASE AGREEMENT <br />THIS LEASE AGREEMENT, made and entered into as of the ~' day of ~~2000, <br />is between Routt County, Colorado by and through the Board of County Commissioners of the <br />County of Routt, hereinafter referred to as "Lessee," and Jane Katherine Hooker, and Avis H. <br />Funk, hereinafter referred to as "Lessor." <br />RECITALS: <br />A. Lessor owns a certain tract of land described below which Lessee has heretofore <br />used to mine gravel. . <br />B. Lessee desires to continue to use the property described below to mine gravel. <br />C. Lessor desires to lease to Lessee the property described below for the purpose of <br />mining gravel. <br />AGREEMENT: <br />;, <br />~ THEREFORE, Lessor and Lessee, in consideration of the promises and covenants <br />stated in this Lease Agreement, hereinafter called the "Lease," and other good and valuable <br />consideration, the adequacy of which is acknowledged, agree as follows: <br />1. Premises. Lessor is the owner of a certain tract of land, hereafter called the <br />"Premises," situated in Routt County, State of Colorado, and described in the Mined Land <br />Reclamation application filed by Lessee, as the North ~fi of Section 12, Township 6 North, <br />Range 88 West of the 6th P.M. The Premises includes and is adjacent to the existing gravel <br />pit. Expansion shall be in a southeasterly direction at the same elevation as the existing pit. <br />2. Pu os . Lessor leases the Premises to the Lessee for the sole purpose of <br />quarrying, mining, removing, crushing and processing gravel, sand and rock, collectively <br />referred to as "Materials." Lessee shall also have the right to establish an asphalt or concrete <br />batch plant if permitted in accordance with federal, state and local regulations. Lessor <br />warrar_ts title to the Materials and the Premises. <br />3. Term of Lease. This Lease shall be in effect for a period of five (5) years from the <br />day and year frrs,: wr.: en above to and including 3/28/2005. Lessee shall have the option to <br />extend the term for an add`:tional five (5) year period. The= option shall be exercised, by serving <br />written notice of Lessee's election upon Lessor not less than ninety (90) days prior to <br />_ expiration of the initial term.
