<br />W1IE4EAS, on April 26 , 1979 , the 2?ined Land Reclamation Board approved
<br />Routt County Road Department's application and set bond; and
<br />k"HER~yS, on April 26 19 79, the Mii:ed Land Reclamation Board accepted
<br />surety submitted by Routt County Road Department and such date shall be considered the
<br />Sate of issuance of the permit and the anniversary da*_e for all other purposes; and
<br />GTdEREAS, tite }*.ined Land Reclamation Beard has made a finding, for the purposes
<br />of issuing this permit, that:
<br />i) ti:e application complies w;rh the requirements of the Colorado
<br />dined Land Reclamation ict ar.d all applicable local, state and
<br />Fec:eral laws; wad,
<br />2) the ooenstion will not adversely affect the stability of any
<br />significant, valuable, and permanent man-made s*_ructures located
<br />within two hundred feet of the affected land, except where there
<br />is an agreeme*.±t between the operator and the persons.hacing an
<br />interest in the structure that damage to the structure is to be
<br />compensated for by the operator; wad,
<br />3) the proposed mining operations and reclamation can be carried cut
<br />in conformance with the requirements of C.R.S. 19'3, 34-32-116, as
<br />amended (1975 Sess. Laws H.B. 1065); and
<br />'vriER.=.dS, for the purposes of issuing this pe*nnit, the operator has made a
<br />satisfy^_tory showing to the Board that he will employ durir.s and alter his
<br />open mining operations procedures reasonably designed to minimize
<br />as ~:uth as practicable the disruption from the open mining operations
<br />and will provide for *_he rehabili*_ation of the affected land through the rehabilitation
<br />of plant cover, soil stability, water resources, and other measures appropriate to the
<br />subsequent ber_eficial use of such mined and rec'_aimed lands; and that in the evenr
<br />of the failure of his proposed reclamaticn plan, he will take whatever measures which
<br />may b2 ..ecessary in order [o assure the success of reclamaticn of the lands affected
<br />by his open mining eperation.s; and,
<br />'h2.r.F.E.AS, for the purposes of issuing this permit, a copy of the application
<br />approved by the Mined Land Reclamation Board of the State of Colorado is attached
<br />to this rermit and thereby becomes a part of the terms hereof.
