BANTA, Dfreetor
Memorandum
T0: Mike Long, Coal Program Supervisor
FROM: Michael Savage, Senior Reclamation Specialist ~~~
_ RE: La P1`ta Coal Corporation Civil Penalties ( our file C-87-072)
DATE: June 8, 1989
This morning I spoke with Duane Senske of Central Collections regarding La
Plata Coal Corporation's outstanding civil penalties which have been referred
to Central Collections. Mr. Senske stated that he could not find any officers
or responsible parties of La Plata Coal Corp. but that a TCM company
(presumably TCMI) of Colorado Springs had purchased the outstanding stock of
La Plata Coal Corp. His questions to me, which I would like the Attorney
General to review, are whether those outstanding civil penalties are now the
responsibility of TCMI, that is, are those liabilities transferable to the new
company and can he legally seek those penalties from the new company?
6975E
215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
