C-93-].50, issued on December 3, 1993. The current status of <br />NOV C-93-150 is:described below. . . ..... <br />Nature of Violation: 1) Failure to have qualified registered PE;•or individual under direction <br />of same, conduct quarterly inspections of refuse pile. 2) Failure to have qualified registered PE, or <br />individual under direction of same, conduct quarterly inspections of sediment pond. 3) Failure to <br />maintain air emissions permits. <br />Remedial Action Required: 1) Have qualified registered PE, or individual under direction of <br />same, inspect refuse pile and sediment pond for 4th quarter 1993. 2) Submit copies of refuse pile <br />and sediment pond inspection reports to Division and place additional copies on file at Raton <br />Creek Mine office. 3) Renew air emissions permits. <br />Current Abatement Status: <br />Step 1: A professional engineer inspected Raton Creek's refuse embankmentl and sediment <br />pond on December 28, 1993. <br />Step 2: EFMC received certified inspection reports for the refuse embankment and sediment <br />pond on January 5, 1994. One copy of each report is enclosed for your files. Addit%onally, copies <br />of.these reports have been placed on file at the Raton Creek Mine office. <br />0 <br />Step 3: EFMC contacted. Mr. Louis McBride'.at the Colorado Department of Health .to <br />discuss emission permit requirements for the Raton Creek Mine. Mr. McBride stated that he <br />concurred with EFMC's.previous cancellation of Raton Creek's emission permits based on his belief <br />of the site..being less than 25 acres in. size.
