M-77-153 <br />Notice of Completion ~ <br /> <br />This letter and attached statement is to request release of the financial warranty for <br />the above referenced mine. The mine is located in Adams County, in parts of the SW~/s of <br />Section 3, and the SE',4 of Section 4, T-2-S, R-67-W, 6TH P.M.. Mining ended in the fall <br />of 2002 and parts of the reclamation is complete. In 1998 Denver Water Department and <br />South Adams County Water and Sanitation District (collectively called Denver Water from <br />this point on) purchased this site to develop it as part of a lager water storage facility <br />encompassing three other gravel mines. <br />In the sales agreement Albert Frei and Sons, Inc., was given until February 2003 to <br />remove any remairdng gravel-from Lhe site. Denver Water responsible for instructing the <br />reservoir and doing any bank sloping needed to that end. At this time mining is complete <br />and the reclamation left to be done is Denver Waters responsibility. It is our understanding <br />that they plan to do this as the storage facility is developed. We are presenting a copy of a <br />letter sent by Denver Water to the Divisions supporting this release request. An affidavit <br />stating reclamation is complete is not part of this submittal since the only reclamation <br />completed to date is sloping of the south bank and the northwest quadrant of the mine. The <br />south bank was temporally seeded to control erosion and the area in the northwest quadrant <br />was seeded. Trees were planted in this area many years ago. Not other reclamation is <br />complete per our land sale agreement with Denver. We feel the letter from The Denver <br />Water Department, exercising their property owner rights, absolves us from completing the <br />reclamation as approved and that when the reservoir is built the site will be reclaimed. <br />NbV = NoN~ <br />-~~ = 2"1(04 <br />
