On July 18, 2002, the Division of Minerals and Geology conducted an inspection of your operation and found the
following: Fremont County is excavating and removing sand and gravel material from an unpermitted azea in Section
20, T 48N - R 11E, NMPM, Fremont County, about 3 miles north of Coaldale, Colorado.
We believe this is in violation of: C.R.S. 34-32.5-109 for Mining Without a Permit.
Therefore, we have reason to believe that a violation exists and have scheduled this matter before the Mined Land
Reclamation Boazd.
A Formal Public Hearing will be held during the September 18-19, 2002 Boazd meeting for consideration of possible
violation. The hearing will beheld in Room 318 of 1313 Sherman Street, Denver, Colorado, beginning at 10:00 a.m.
on September 18 and at 9:00 a.m. on September 19. Depending on the day that your hearing is scheduled, this matter
will begin at those times or as soon thereafter as the matter can be considered. At that hearing you will have the
opportunity to be represented and heazd. It will be reiterated that there is reason to believe that you aze in violation of
the provisions noted above.
If the Board finds a violation at this hearing, it may issue a Cease and Desist order, require certain corrective actions and
assess a Civil Penalty in the amount of $1,000.00 to $5,000.00 for each day of violation. If you have evidence indicating
that the possible violations noted above do not exist or have been corrected, please provide it [o us as soon as possible
or bring it to the hearing.
