(Page 2) <br />MINE ID # OR PROSPECTING ID #: tit-zom-na; <br />INSPECTION DATE: 7-t8-02 INSPECTOR'S INITIALS: ~lL <br />OBSERVATIONS <br />Completed an inspection of this operation after the Division received an amendment application (using M-1978-096 permit <br />number) to expand the existing disturbed area. After the Division reviewed the amendment application, which indicated <br />that the location of the proposed expansion area is in Section 20-T48N-R11 E (not Section 5-T47N-R11 E where M-1978-096 <br />is located), the Division decided to inspect this proposed expanded area and the M-1978-096 permit area. Both areas were <br />inspected on July 18, 2002. <br />This operation is located in Section 20-T48N-R11E as the application states. This is an unpermitted site. It was permitted at <br />one time but the permit was terminated (in 1991) after the County requested a release. As such, Fremont County is <br />operating an illegal mining operation. An RTB letter will accompany this inspection report. Fremont County will be required <br />to attend the September 18-19, 2002 Mined Land Reclamation Board meeting to explain why this pit was reropened and re- <br />disturbed without obtaining a Reclamation Permit. <br />Mr. Garrett said there is some confusion regarding this disturbance and the Coaldale Pit (M-1978-096). Apparently, Fremont <br />County thought they were closing the M-1978-096 pit when they submitted a release request. However, the request for <br />release in 1991 specifically stated permit M-1984117 (the permit number for this terminated pit). <br />Currently, approximately 5-6 acres are disturbed. The pit daylights to the south with a 10-15 foot highwall located on the <br />north end. Mining progressed from north to south. Except for a small erosional feature in the northeast corner of the pit, the <br />pit is stable. Native vegetation has invaded the small highwall on the west side of the pit. Did not observe any potential <br />environmental problems. <br />Mr. Garrett was briefed on the possible violation process. He was told that if the Board finds a violation, the County could <br />be assessed a civil penalty in the amount of $1,000 to $5,000 for each day the land has been affected, not to exceed 365 <br />days (see C.R.S. 34-32.5-123(2)). The Board may order the County to obtain a 110 Limited Impact permit or a 112 Regular <br />permit (depending on the desired size of the permit area). Mr. Garrett said the County may just want to reclaim the site. If <br />so, a reclamation only 110 permit would be appropriate (since the current disturbance appears less than 10 acres). The <br />Board may issue a Cease and Desist Order if a violation is found.
