CO-2003-012 Ab temen Deadline Extension Request o'V 1j~~~ ~t M~"eja~s and ~eplagY <br />Dear Mr. Boulay, <br />Seneca Coal Company (SCC) respectfully requests an extended abatement date for topsoil replacement and <br />seeding at the Valora Pit specified in CO-2003-012. The specified tune fox abatement is on or before April <br />18, 2004. <br />In compliance with the CO-2003-012, SCC has completed backfill and grading activities in the 2001-2002 <br />area shown on Exhibit 19-1A. However, topsoiling and seeding activities cannot be completed due to <br />climatic conditions (i.e. muddy conditions). The topsoiling would require that topsoil be placed over <br />saturated (extremely muddy) spoil and placement by scrapers under these conditions causes deep ruts and <br />unsafe operating conditions. <br />Therefore, under Rule 5.03.2(c) ".....Cirrumrtancer which may guat~ a surface coal mining operatiau for an abatement <br />period of more than 90 dayr are:....'; and specifically with reference to Rule 5.03.2(2)(c)(iv) `inhere climatic caudztionr <br />preclude abatement within 90 days, or where, due to climatic candition.r, abatement within 90 days clearly would cause mote <br />envimnmentalharm than it wouldpreventar;"SCC believes that attempting to place topsoil over saturated regraded <br />spoil would cause more harm. <br />SCC respectfully requests an extension to the abatement date be granted for topsoiling, seeding, and postmine <br />channel construction activities until climatic conditions improve.
