ti <br />NOV C-98-005 <br />Southfield Mine <br />This NOV was issued for failure to construct and maintain a light use road so az to control or <br />prevent erosion and to prevent contribution of additional suspended solids to runoff outside the <br />permit area. <br />HISTORY <br />One NOV (C-97-019) was issued on November 3, 1997. Because this NOV waz issued within <br />the past twelve months, $50 is assessed (or history. <br />SERIOUSNESS <br />Several gullies of fairly significant dimension were observed to have been caused by runoff from <br />the road cited in the NOV. There is no direct evidence of observable impacts outride the <br />permit area other than the gullies themselves. Furthermore, it is not clear how much of the <br />erosion cited in the NOV has occurred since the operator began using the road az part of their <br />permitted mining operations, since the road existed prior to issuance of the Southfield Mine <br />permit. Due to the limited impacts and azsuming that some of the erosion occurred prior to use <br />of the road by the operator, $250 is azsessed for a low level of seriousness. <br />FAULT <br />The road cited in the NOV apparently existed for several years prior to the time it was <br />incorporated into the Southfield Mine permit. It is very likely that some of the observed <br />erosion occurred prior to that time, az well. It is therefore unclear how much responsibility the <br />operator had to prevent the erosion which occurred. However, the operator is responsible for <br />maintaining the road to prevent or control the continued occurrence of erosion due to road <br />runoff. $250 is assessed for a low level of negligence. <br />GOOD FAITH <br />The NOV has not been abated az o(this date.
