Guffey <br />I have received your letter of June 2, 1994, with the <br />enclosures relative to the requirement of the Mined Land <br />Reclamation Board with respect to reclamation of the gravel <br />operation under Permit #M-91-097. I am somewhat surprised at <br />your suggestion that Ruth Abbott should comply with the <br />reclamation requirements. As you may recall, the settlement in <br />Case No. 93 CV 59 only requires Ruth to sign a transfer <br />authorization since it was contemplated the property was to be <br />sold to Mr. Brill and he would continue operating the pit, or in <br />the alternative your client Mr. Guffey would continue operating <br />the pit. In compliance with this agreement, Ruth has signed a <br />blank transfer and it was sent to your office on May 24, 1994. <br />We assume this documents complies with C.R.S. 34-32-119 which <br />normii•c one oper,tor to succead another and to complete the <br />operations. <br />If Mr. Guffey wants to terminate operations, it is his <br />obligation to reclaim the pit. I am sure Ruth can arrange to do <br />so with the help of Tommy Watson, but before commencing any such <br />operation, we would expect your client to make arrangements for <br />payment either in the form of a deposit, or an agreement to pay <br />specified unit and equipment charges. <br />We recognize that the Mined Land Reclamation Board is <br />looking to the permit holder to reclaim the pit since operations <br />have terminated. This being the case, it will be necessary to <br />resolve these issues as quickly as possible to avoid any <br />sanctions. By copy of this letter I will notify the staff of <br />
