As you know, a number of items pertaining to this operation were presented to
the Mined Land Reclamation Board (MLRB), at their January 23, 1985 meeting.
The following is a reference to each agenda item discussed and the ultimate
outcome.

The MLRB approved your continuance request to defer MLRB consideration
of this amendment to the April 24 - 25, 1985 meeting. The basis of
this request was to allow for more time so you can obtain Clear Creek
County rezoning.
Agenda Item #6:
The MLRB continued the Formal Public Hearing to consider civil
penalties for mine-related activities outside of the permit area to the
A ril 24 - 25, 1985 meetin The basis for this continuance was to

penalties would be heard simultaneously with the consideration of the
above referenced amendment.
Agenda Item #7:
The MLRB ultimately decided to send a letter to the Clear Creek County
Commissioners expressing remorse for any misunderstanding and offering.
to rescind the previous approval of the technical revision if so
desired by the Clear Creek County Commissioners. Therefore, the issue
of rescinding the technical revision was tabled dependent upon the
outcome of Clear Creek County Commissioners' response to the MLRB
letter.
The Division is now in the process of sending the MLRB requested letter
to the Clear Creek County Commissioners.
