Savage SAVOC~~ <br />RE: Civil Penalty Assessment for NOVS 81-14, 81-15, 81-16 <br />I have assessed the following amounts of civil penalties for NOV 81-14 <br />(operating without an approved permit)at $2,560.00; NOV 81-ZS (failure <br />to construct sediment control prior to disturbance) at$2,590.00; <br />NOV 81-16 (failurn to protect stockpiled topsoil) at $2,310.00. These <br />amounts were derived based on the following assumptions and calculations: <br />NOV 81-14 <br />A. History: (Bourg has had two violations issued within the last <br />year, NOV 80-29 (8/6/80) and NOV 80-39 (10/28/80)). <br />For each violation, 550.00 must be assessed. <br />History Total: $ 100.00 <br />B. Seriousness: <br />1. Probability of Occurence: (damage did occur due to the re- <br />moval of vegetation and topsoil and operation in the marshy <br />area:) Since damage occured, an assessment of $875.00 is levied. <br />Occuren ce Total: $ 875.00 <br />2. Duration and Extent of Viloation; <br />a. Duration: (A long duration time was assessed since no <br />plans have been received which would indicate a correction <br />of the problem.) Since a long duration time was assessed, <br />the penalty is $437.50 <br />b. Extent: (The extent was relatively small, Less than 10 <br />acres.) The penalty for small extent is placed at $145.83. <br />Seriousness Total: 51,458.34 <br />
