Jim <br />Agner, the plant manager, has discussed with me your findings and concerns brought up during <br />the inspection. Please consider the following when determining whether an amendment technical <br />revision is required. <br />1) Last year, we agreed to allow Hyponex to stockpile some materials on our property. These <br />stockpiles were non-toxic topsoil, straw/manure, and compost organic material only. These <br />material was originally placed within the current mining area, so we were not disturbing any <br />additional land within our mining permit restrictions. As their need for more area grew, we <br />began contemplating leasing out a small portion of the property to them. At that time, I talked <br />with Larry Oehler about this and he informed me that no changes would need to be made to the <br />permit. However, he did suggest that I send in a map showing the ]eased area to avoid any <br />confusion. I intended to do that on the next annual report. <br />2) A lease was signed in late August for a five acre parcel near the scale house and a two acre <br />parcel in the mining area. Since I was informed that the leased area would not be considered <br />part of our mining operation, they have been advised to use up the materials in the mining area <br />and try to consolidate their material in the area around the scale house. <br />Please find attached a copy of Exhibit A from the lease, showing the leased areas.
