<br />NOV C-93-078 <br />Foidel Creek Mine <br />History <br /> <br />One NOV (C-93-020) was issued on April 1, 1993. $50 is assessed <br />for history. <br />Seriousness <br />The disturbance next to Pond B was outside the sediment control <br />system. Placing and spreading excavated material here created the <br />potential for sediment to be transported offsite by runoff. In <br />addition, the vegetation which the material was spread on was <br />apparently damaged or destroyed. <br />Damage caused by the stuck vehicle was of limited extent but, it <br />was in an area that was not planned or permitted for disturbance by <br />mining operations. <br />$750 is assessed for moderate seriousness because of damage to <br />vegetation and disturbance outside the sediment control system and <br />in areas where disturbance was not planned or permitted. <br />Fault <br />Placing and spreading excavated materials outside the sediment <br />control system, directly adjacent to a sediment pond and driving a <br />vehicle over undisturbed ground seem to be intentional acts. It <br />appears these were done by contractors on the mine site. The <br />operator is responsible for the actions of contractors working on <br />the mine site. $1000 is assessed for fault because the acts which <br />created the violations were done knowingly. <br />Good Faith <br />There is no evidence of extraordinary measures. <br />c:\wp51\61493b <br />
