FINDINGS OF FACT
Pursuant to the authority vested in the State of Colorado t4ined Land
Reclamation Board by C,R.S. 34-32-124, the Board hereby makes the following
findings of fact:
1, Climax Molybdenum is permitted to conduct a mining operation under the
terms of Permit M-77-493 located in Township 8 South, Range 79 West, and
Township 7 South, Range 79 West, and Township 7 South, Range 78 West of the
6th P.M„ in portions of Lake, Summit, Eagle and Park Counties, Colorado.
2. The Mined Land Reclamation Board conducted a Formal Public Hearing in
accordance with C. R, S. 34-32-124(5) on November 20, 1986 to consider possible
violation of the terms of Permit M-77-493 and C.R.S. 34-32-101 et seq,
3. The (lined Land Reclamation Division (Division) presented evidence at the
Formal Public Hearing on November 20, 1986, demonstrating that:
a) The Division received a memorandum dated August 22, 1986, from Mr,
David H. Getches, Executive Director of the Colorado Department of
Natural Resources, describing poor visibility on Highway 91 adjacent to
the Climax Mine due to airborne particulates emanating from the Climax
t4ine tailings pond areas.
b) On September 16, 1986, the Division conducted an inspection of the
Climax tAine, and observed large quantities of tailings dust blowing from
the tailings dam and pond surfaces, tduch of the tailings dust was
blowing off-site.
c) On September 18, 1986, the Colorado Department of Health conducted
an inspection of the Climax Mine site. On that date, fugitive
particulate emissions in excess of 20 percent opacity were observed to
be emanating from the tailings impoundments,
d) The Division received a letter dated October 20, 1986, including
photographs which depict blowing tailings dust being transported
off-site. The pictures were taken on September 20, 1986.
