~- <br />1111111111111111111 <br />9~ <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: <br />Climax Molybdenum Company <br />File No. M-77-493 <br />T0: Climax Molybdenum Company and all <br />controlling the following operation: <br />Summit, Eagle and Park Counties. <br />NOTICE OF VIOLATION M-86-085 <br />AND <br />ORDER TO MODIFY PERMIT AND <br />ORDER TO PAY CIVIL PENALTIES <br />other persons engaged in or owning or <br />Climax Mine - In portions of Lake, <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado t4ined Land <br />Reclamation Board by C,R.S. 34-32-124, the Board hereby makes the following <br />findings of fact: <br />1, Climax Molybdenum is permitted to conduct a mining operation under the <br />terms of Permit M-77-493 located in Township 8 South, Range 79 West, and <br />Township 7 South, Range 79 West, and Township 7 South, Range 78 West of the <br />6th P.M„ in portions of Lake, Summit, Eagle and Park Counties, Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public Hearing in <br />accordance with C. R, S. 34-32-124(5) on November 20, 1986 to consider possible <br />violation of the terms of Permit M-77-493 and C.R.S. 34-32-101 et seq, <br />3. The (lined Land Reclamation Division (Division) presented evidence at the <br />Formal Public Hearing on November 20, 1986, demonstrating that: <br />a) The Division received a memorandum dated August 22, 1986, from Mr, <br />David H. Getches, Executive Director of the Colorado Department of <br />Natural Resources, describing poor visibility on Highway 91 adjacent to <br />the Climax Mine due to airborne particulates emanating from the Climax <br />t4ine tailings pond areas. <br />b) On September 16, 1986, the Division conducted an inspection of the <br />Climax tAine, and observed large quantities of tailings dust blowing from <br />the tailings dam and pond surfaces, tduch of the tailings dust was <br />blowing off-site. <br />c) On September 18, 1986, the Colorado Department of Health conducted <br />an inspection of the Climax Mine site. On that date, fugitive <br />particulate emissions in excess of 20 percent opacity were observed to <br />be emanating from the tailings impoundments, <br />d) The Division received a letter dated October 20, 1986, including <br />photographs which depict blowing tailings dust being transported <br />off-site. The pictures were taken on September 20, 1986. <br />
