This NOV was <br />written for failure to maintain ditches and culverts. Basin <br />Resources is requesting vacation of this NOV. The following ie a <br />summary of the events that took place which we feel warrant <br />vacation. <br />Events Surrounding the Problems Cited in the NOV <br />The New Elk Mine permit require the structures identified in <br />the NOV to be designed to handle a 10 year/24 hour precipitation <br />event. For this mine, such a storm corresponds to 2.9" of <br />precipitation for the entire 24-hour period. <br />However, the storm of August 3 exceeded the 10 year/24 hour <br />precipitation event standard, and for that reason alone caused the <br />conditions identified in the NOV. A total of 2.99" of rain fell <br />during this event, of which 2.65" fell during an intense 4 hour <br />period. It was this intense cloudburst that caused the problems <br />which were seen during the inspection. <br />Immediately following the August 3 storm, Basin began <br />remedying the problems caused by the storm. Hasin committed <br />substantial resources to this cleanup: it devoted approximately <br />500 man-hours and $20,000 to cleanup activities from the time of <br />the storm until the inspection tour ended. Hasin personnel and <br />outside contractors worked steadily to remedy the problems, except <br />where a <br />labor dispute and wet conditions interrupted the remedial work. <br />
