SHELTO N, Director
VACATION OF NOTICE OF VIOLATION
T0: The Operator and Permittee of the Mine Described Below:
Notice of Violation No. C-84-165 Mine New Pryor Strip
Permit No. C-031-81
Operator (if other than Permittee)
County Huerfano
Type of Mine Surface
Permittee American Fuels, Inc.
Mail Address
Mail Address P.O. Box 511
Aguilar, Colorado 81020
Good Cause Shown: The operator demonstrated through production of precipitation
records that the entire month of October was extremely wet. The violation was
for failure to maintain the collection ditch. Given the extremely moist
conditions of the site, it would have been extremely difficult, if not
impossible, to yet equipment in to maintain Lhe seguu~nt of the ditch where
sediment had collected. Use of equipment on the very rvet ground in all
probability would have caused severe damage itself. Therefore, I find that the
operator acted prudently in waiting until the ground dried prior to ditch
cleaning and thus find that no violation occurred.
The shove-captioned Notice of Violation is Hereby vacated, effective
T~ 3 0 >/9k-S
MINED LAND RECLAMATION DIVISION
Date ~~. 3y , /9~rS
//'~
By ~/Gy-->~~ - c~
tgnature of authorized representative
Please print name & title
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
