Danielson, Esq. <br />Gersh & Danielson Attorneys <br />1775 Sherman Street, Suite 1875 <br />Denver, Colorado 80273 <br />Dear Luke: <br />Thanks very much for sending me the package f <br />materials regarding Battle Mountain Gold's progre s in <br />San Luis. <br />When we talked about this problem earlier th~.s <br />year, you indicated that the MLRB would not have <br />approved Battle Mountain Gold's permit for a tail~ngs <br />pond with a single synthetic liner, if MLRB had a er <br />anticipated the cyanide levels would be as high a~ in <br />fact occurred. However, it appears that MLRB is <br />continuing to permit Battle Mountain Gold to operte <br />with cyanide levels discharged into the tailings and <br />approximately twenty times greater than those all wed <br />by the permit. It also appears that the state is <br />taking a fairly relaxed approach to the timing an~ <br />seriousness of responding to this situation. <br />I am also concerned that there appears to be'~no <br />action taken, or planned or proposed, to assess t e <br />quantity and concentration of cyanide which has b en <br />deposited in the tailings slurry. As discussed i my <br />previous letters, this is a separate issue from t e <br />level of cyanide detected in the decant water on he <br />top of the slurry. An evaluation of the amount o <br />cyanide which has been accumula*_ed within the dep sit <br />tai^ lin ~s is a necessity before the M~li~can` arri a <br />responsible, final, disposition of this issue. <br />I hope that you, and the Mine Land Reclamati n <br />Board, will adopt a higher level <br />on this issue.
