Telaphate: (719j 473-4660
10000-88049
July 13, 1988
Gregory M. Nagel
7 East Bijou, Suite 214
Colorado Springs, CD 60903
SUBDIVISION ACCESS RaP,D - DEBRIS
'This letter acknowledges your letter dated July 7, 1988, expressing youe-
concerns regarding our client, Castle Concrete Co~any's Snyder Quarry FSOad
accessing its Snyder Quarry operation. Improvents to the shoulders of that
road have been made over the years by our client to improve a difficult mining
road, to make it safer and more useable by heavy haul trucks. Shoring up the
shoulders is the primary method of acoomiplishing road improvements. However,
our client is currently evaluating these access road fills, and will continue to
evaluate these fills. As to the debris washing on the Black Canyon Road leading
to the access of the Cedar Heights Subdivision, I am informed by our client that
the recent heavy rain and the clogged culvert installed by the developer of
Cedar Heights caused problems on the Cedar Heights access road, attributed
primarily to the inability of the subdivision's drainage pattern to handle that
wlume of water in such a short time. Our client did, without expense to the
homeowners association, assist in the removal of material and did so as a good
neighbor. Our client was not under any legal obligation to help out, or clear
the road.
We trust that this act of a good samaritan is not being cronstrued as any
admission of liability of our client for that particular problem.
F.VANS & BRIGGS
Vice President
Colorado Springs, CO 80901
Castle Concrete Company
Attn: Gordon K.
