Shelton <br />Director <br />The Division would like to express thanks for being able to meet with <br />representatives of Kerr Coal regarding the notices of violation issued <br />to Kerr Coal last month. <br />Included with this correspondence is a notice of proposed civil penalty <br />and accompanying explanation of how the civil penalty was assessed. <br />At this time the Division has decided to assess a civil penalty for <br />NOV 82-16, and to vacate 'dotices of 'Jiolation 82-17, and 82-19. <br />According to the monitoring plan submitted and initiated by Kerr Coal <br />in October 21, 1981 correspondence to the Division, all appropriate <br />monitoring records were on file at the time of the inspection. <br />Upon consideration of the evidence presented by Kerr Coal relative to <br />NOV 82-19, the Division has elected to vacate this violation. The <br />Division and Kerr Coal should closely monitor the reconstructed net[ing <br />over the next three months, at which time the merits of the system <br />will be reevaluated to determine if an alternative system would better <br />serve the requirements of Kerr Coal and the Division. <br />If you have any questions please feel free to contact the Division. <br />Sinc r/~ely J/ ~ ,. <br />/'r d fkt.
