<br /> <br />Ms. Carla Lenkey <br />December 29, 1997 <br />Page 4 <br />procedures were not very safe, due to the amount of head and <br />potential to be sucked underwater once the spillway started to <br />discharge. Based on the circumstances and approaches Seneca <br />attempted previously, this was about the only method left to <br />clear this spillway. We believe that the time constraint placed <br />on us to abate the violation, unduly put one of our employees at <br />risk. Dennis notified you of the upset condition at Discharge <br />Point 006 in his letter dated September 26th <br />Water quality samples were obtained for the discharge that passed <br />through the emergency spillway and for the discharge that <br />occurred immediately after the primary spillway was unplugged by <br />both CDMG and SCC. Dennis reported the results of this sample to <br />you in his October 23rd letter. <br />Once the water level had receded to uncover the primary spillway <br />we noticed that the pond had completely filled up with sediment. <br />For your information, Pond 006 was dredged in July 1996 and we <br />removed approximately 5 acre-feet of sediment. As Dennis reported <br />to you in his October 31st letter, in order to facilitate <br />sediment removal from the pond, a ditch was dug through the <br />embankment to remove the remaining water in the pond. As a <br />sediment control measure, silt fence was placed at the outlet of <br />the ditch to filter the water and sediment. The ditch discharged <br />water from 2:00 p.m, on the 29th until 10 a.m. on the 31st. We <br />then constructed a roadway from the embankment out into the <br />middle of the pond. The sediment was removed from the pond by <br />loading it into end dump trucks with our trackhoe. Dennis sampled <br />the water that discharged on the 30th, and the results reported <br />to you in his letter of November 14th <br />Seneca tried everything in our power to clean the pond as best as <br />we could and maintain the integrity of the pond itself. The <br />entire problem caused at Pond 006 was caused by the excessive <br />storm events we received at the end of September. The pond <br />functioned the way it was designed to, with the exception of the <br />trash rack getting plugged.
