C~ <br />Page I <br />ORDER <br />• <br />Based on the above findings of fact and conclusions of law, the Board ORDERS that: <br />1. Connell is hereby found to be IN VIOLATION of Section 34-32.5-116(4)(1), C.R.S., for <br />causing damage to areas outside [he affected land during mining operations or reclamation. <br />2. Connell shall CEASE AND DESIST from further mining activities in the area of violation, <br />except for reclamation tasks. <br />3. Connell shall comply with the following CORRECTNE ACTIONS: <br />• Reclaim [he disturbed area outside the permitted affected land in conformity with [he reclamation <br />requirements set forth in Connell's reclamation permit within 120 days of the effective date of this <br />order; and <br />• Conduct reseeding operations for the above reclamation activity during the period October 15, 2001, <br />and November ] 5, 2001. <br />The rights and obligations of recipients of a Notice of Violation/Cease and Desist Order are described in the <br />Colorado Land Reclamation Act for the Extraction of Construction Materials, Sections 34-32.5-101 et sec , <br />Colorado Revised Statutes. <br />Nothing contained herein, particularly those portions requiring certain acts to be performed within a <br />certain time, shall be construed as a permit or license to engage in any prospecting or mining operations <br />within the State of Colorado. <br />~--, <br />Dated thi~ day of , 2001 <br />MINED LAND RECLAMATION BOARD <br />Michael B.
