Box 58 <br />Delta, Colorado 81416 <br />Re: Civil Penalty for Failure to Abate NOV CV-84-004 Within the Set <br />Abatement Period <br />Dear Mr. Mitchell: <br />In accordance with C.R.S. 34-33-101 et s~ce and the regulations adopted <br />pursuant thereto, I am assessing a civil penalty for failure to abate NOV <br />CV-84-004 within the specified abatement period. An inspection was made on <br />March 22, 1984 of the coal stockpile area which was the subject of the above <br />cited violation. At that time it was found that the abatement had not been <br />completed. The abatement was completed on March 29, 1984 and thus, the period <br />of non-abatement is set at 7 days. The Division is required to assess a civil <br />penalty of not less than $750.00 per day, and therefore, the total civil <br />penalty owed to the State of Colorado is $5,250.00. <br />If you have any questions regarding this assessment, please contact me. <br />Payment is due within 30 days.
