The Board appeared to feel that the County had not <br />really availed itself of the opportunity to demonstrate, by means <br />of its survey and illustration of the permit area, that all mining <br />related disturbance might actually be within the approved permit <br />area. <br />Any corrective action ordered by the Board, should it have heard <br />and found a violation for damage outside the permit area at the <br />February 27, 1997 meeting, would probably have included requiring <br />the County to submit an amendment or conversion application which <br />would include all land disturbed outside of the current permit <br />area. As a result, the Division is prepared to withdraw the <br />violation from further consideration by the Board if the County <br />will diligently pursue and secure approval of its recently <br />submitted ,conversion application prior to the June 25-26, 1997 <br />hearing. Approval of the conversion application would bring the <br />Airport Pit into compliance, which is the Divison's primary <br />concern, and the withdrawl would eliminate any need by the County <br />to resurvey and mark the current permit area boundaries. <br />Should you have any questions on the above, please contact me. <br />Sincerely, <br />_.
