Brown Division of Minerals 8 Geology <br />Colorado Division of Minerals and Geology <br />1313 Sherman Street - Room 215 <br />Denver, CO 80203 <br />RE: NOTICE OF VIOLATION #CV-99-012 <br />RFRR COAL COMPANY - PERMIT #C-80-001 <br />Dear Ms. Brown: <br />As you and I discussed over the phone, topsoil adjacent to the <br />drainage ditch of your concern was actually stripped prior to <br />disturbance of the area. However, the subsoil from the trench <br />excavation that was piled next to the topsoil berm did spill onto <br />the topsoil berm along a portion of the berm as you stated. I <br />mention "subsoil" to make the point that contamination to the <br />topsoil was not a risk. <br />TOPSOIL: As I mentioned on the phone, the topsoil was salvaged by <br />carefully removing the subsoil from the topsoil and creating a <br />buffer between the two mediums. This was completed October 15, 1999 <br />while I was at the site. <br />DITCH: The drainage ditch was re-established along and adjacent to, <br />the toe of the fill slope immediately after the subsoil cover (cap <br />over the Tipple coal slack) was push/dozed into place. The ditch <br />was completed October 25,1999. Topsoil replacement on the new fill <br />slopes is in progress and is approximately 30$ complete at this <br />time. <br />SEEDING: The disturbed areas adjacent to and east of the re- <br />established ditch at the toe of the fill slopes have been reseeded <br />with the approved seed mix. <br />I trust these procedures satisfy your concerns and justifies <br />abatement of the referenced violation with good faith <br />consideration. <br />Sincerely, <br />~~ rs..-.---~ <br />~'Xge,V.
