C. The Undisputed Facts Confirm the Board' s Finding that <br /> Plaintiffs Received Full and Adequate Notice of the <br /> Nottingham Application. <br /> The central thrust of Plaintiffs' Complaint is that the <br /> Trust, as an alleged adjacent landowner, did not receive the <br /> notice to which it was entitled under the Act, the Rules and <br /> Regulations of the Board and the due process clauses of the state <br /> and federal Constitutions. See, Complaint at 112 and 5-8. The <br /> undisputed facts, on the other hand, demonstrate conclusively that <br /> Plaintiffs received the requisite notice. <br /> The applicable statutory and regulatory requirements are <br /> specific and detailed. Compliance with these is readily demon- <br /> strated. First, the permit application must be filed for public <br /> inspection at the offices of the Board and the Clerk and Recorder <br /> for the county where the operation is located. Section 34-32- <br /> 112(10 ) (a) , C.R.S. 1973. The Nottingham Sand and Gravel applica- <br /> tion was so filed. [Heifner Affidavit, $6. ] Next, notice that <br /> the application has been filed, including the identity of the <br /> applicant, the location of the operation, the date by which oppo- <br /> sition statements must be submitted and other information, must be <br /> published for four consecutive weeks in a newspaper of general <br /> circulation in the locality of the proposed operation. Section <br /> 34-32-112(10) (b) , C.R.S. 1973. Attached as Exhibit 3 to the <br /> Nottingham Affidavit is the proof of publication from the Eagle <br /> Valley Enterprise establishing that the necessary newspaper notice <br /> was effected. <br /> Finally, a copy of the newspaper notice must be sent by <br /> certified mail to all landowners immediately adjacent to the <br /> operation. Alleged noncompliance with this requirement forms the <br /> crux of Plaintiffs' claims. The undisputed facts regarding notice <br /> to adjacent landowners in this case speak for themselves. <br /> A copy of the newspaper notice of the application was <br /> sent by certified mail to the mailing address which the Plaintiffs <br /> have listed on the Complaint as their own address.
