Long, <br />Drvisian Director <br />RE: NOV C-92-008, Kaiser Coal Company, CCMC #1 Mine, Permit No. C-81-024 <br />Dear Mr. Burge: <br />The Colorado Mined Land Reclamation Division regulates mining and reclamation <br />operations around the state. Coal mines must operate under the Regulations of <br />the Colorado Mined Land Reclamation Board for coal mining. Permit approval <br />for coal mining specifically requires an operator to obtain the necessary <br />approvals to disturb any area with 100' measured horizontally of the outside <br />right-of-way line of any public road. <br />The CCMC Mine #1 is located in portions of Section 25 and 36, T27S, R67W, 6th <br />P.M. of Huerfano County along State Highway 69. The operator is completing <br />final reclamation at the site. In the course of grading a ditch closed, the <br />company disturbed land within 80' feet of the outside right-of-way line. <br />CMLRD, on June 3, 1992, issued a violation at the site for failing to comply <br />with this administrative requirement. A copy of the violation and associated <br />narrative is enclosed for your review. <br />I understood during my phone conversation with you that the State Department <br />of Transportation has no specific permitting requirements for areas outside <br />the right-of-way line. You will be receiving a letter from Greys tone <br />Development Consultants, a firm working for Kaiser requesting information <br />about the need for permitting of such a disturbance.
